Simon acted on instructions from the Director of Human Rights Proceedings for 13 plaintiffs who brought a claim against the Ministry of Health alleging discrimination on the grounds of family status. On 11 October 2017, the Court of Appeal gave judgment in favour of the respondents in McLennan v Livaja [2017] NZCA 446. Simon acted for the successful respondents. The decision is important in that it clarifies the legal test for the knowledge required to establish a cause of action in knowing receipt.

Simon has been on the Board of Youth Law since 2015. He is currently the Chair of the Board and sits on the risk and governance and law reform sub-committees.
