Simon instructed by Director of Human Rights Proceedings to act for family caregivers and disabled family members
Simon acted on instructions from the Director of Human Rights Proceedings for 13 plaintiffs who brought a claim against the Ministry of Health alleging discrimination on the grounds of family status. The plaintiffs were parents and spouses of disabled family members and the disabled family members themselves. The plaintiffs alleged that the Ministry of Health discriminated against them by refusing to pay the family caregivers for the care services that otherwise would have been provided by contractors paid by the Ministry. The case was settled and has had significant influence on the government in making changes to law and policy relating to the remuneration paid to those who care for their disabled family members
